By accessing or using PentaReport AI ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

PentaReport AI is a cloud-based penetration testing reporting platform that allows users to:

  • Import vulnerability scan results from various security tools
  • Manage and organize security findings
  • Generate professional penetration testing reports
  • Use AI-powered features for finding deduplication and report writing

3. User Accounts

To use the Service, you must create an account using Google OAuth. You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

4. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose or unauthorized activity
  • Upload malicious code or attempt to compromise our systems
  • Share your account with unauthorized users
  • Resell or redistribute the Service without authorization
  • Attempt to reverse engineer or extract source code
  • Use the Service to store or process data you don't have rights to

5. Data Ownership

You retain full ownership of all data you upload to the Service. This includes vulnerability scan results, client information, and generated reports. We do not claim any ownership rights to your data.

By using our Service, you grant us a limited license to process your data solely for the purpose of providing the Service to you.

6. Subscription Plans & Payment

6.1 Free Tier

The free tier includes limited features as described on our pricing page. We reserve the right to modify free tier limitations at any time.

6.2 Paid Plans

Paid subscriptions are billed monthly or annually. All fees are non-refundable except as required by law or as explicitly stated in these terms.

6.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. After that, your account will revert to the free tier.

7. AI Features & Limitations

Our Service uses AI (Google Gemini) for certain features. You acknowledge that:

  • AI-generated content may require human review and verification
  • AI outputs are provided "as-is" without warranty of accuracy
  • You are responsible for reviewing and verifying all generated content before delivery to clients
  • AI features may be subject to third-party terms (Google AI Terms of Service)

8. Confidentiality

We understand that penetration testing data is highly sensitive. We commit to:

  • Never sharing your data with third parties except as required to provide the Service
  • Implementing industry-standard security measures
  • Ensuring all employees with data access sign confidentiality agreements
  • Promptly notifying you in case of any data breach

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless PentaReport AI and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the Service will immediately cease. You may request export of your data within 30 days of termination.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.
